can i spawn a named entity without having a template in the map beforehand

Why don't you just create the entity, and the point_template? The entity will not show up until it is spawned.

EDIT: Alternatively, have the intel entity off-map somewhere, and teleport it in using a point_teleport.

I just tried it, curious. I think this would be something to email valve about and see if they can fix it because it is definitely what I would consider broken behavior. The train watcher is what "upgrades" collision calculation on the train in question. Normal trains get you stuck in TF2 because TF2 has bad physics. The flag being added causing that to stop working and revert to normal means there is something conflicting.
